The Promotional Contest (Contest) is brought to you by ONDC (Organiser)
The Contest is open to all Indian citizens residing in India, of 18 years of age or above The Contest is open to all Indian citizens residing in India, of 18 years of age or above with a valid Facebook and/or Instagram,X (Twitter) account except the employees of Organizer, Organizer’s associate companies, its agents, its advertising and promotional agencies and its auditors and their associate companies (‘Participant’).
The contest is valid from 16th September 2023 till 16th December 2023 on Facebook, Instagram and X (Twitter)(“Contest Period”). The Organizer may in its absolute discretion curtail or extend the Contest Period, as it deems necessary without any liability whatsoever; and no communication in this regard will be entertained.
By participating in this Contest, a Participant expresses his wishful consent and accepts and agrees to be bound by all these terms and conditions as stated herein at all times without any exception whatsoever. The Organizer reserves the right to change/modify these terms and conditions or curtail/extend/withdraw the Contest at its sole discretion without any prior notice and liability.
Participation is optional. No use of the Organizer’s services is necessary to participate in the Contest.
To participate in the Contest, the Participant has to follow the steps as detailed herein below: a) Be a registered Facebook and/or Instagram user. b) Follow ONDC’s Instagram/Facebook Handle c) Participants must use hashtags such as #HumaraONDC, #BharatKaONDC along with their entries. d) Participants must tag ONDC’s official handle on their entries/creatives, and (e) No 3rd Party / IPR-protected pictures/videos/boomerangs/gifs to be used by any Participant. In case used, no liability of any nature comes on the organiser, and (f) Facebook video post/Meme Post - Minimum 3000 Likes, 500 Reshares; and Instagram post - Minimum 10000 views
Only such submissions of Participants meeting the criteria in Clause 6 above, and are otherwise compliant with these terms and conditions, shall qualify for the Contest ( hereinafter referred to as ‘Valid Entries’ or ‘Valid Entry’). The decision of the Organizer with regard to the validity of the entries shall be final and the Organizer shall entertain no claim or communication with respect to that entry by the Participant.
Participant, without any exception and at all times during the Contest Period shall follow all post instructions given by the Organizer in its entirety. Any failure to comply with the instructions of the Organizer will result in the disqualification of the entry made by the Participant.
The Participants submitting their entries other than during the time of the Contest Period as per Clause 3, shall not be eligible for the Prize (as defined hereinafter).
Participants can participate in the Contest as many times as he/she wants during the Contest Period but can be selected as a Winner only once.
Declaration of ‘Winners’ – A total of 30 winners will be selected during the Contest Period, under this Contest. 5 winners will be declared after every 15 days.
Winners will be declared on the ONDC’s Instagram, Facebook and X (Twitter) page.
It is clarified that the Organizer’s commitment under this Contest is subject to the number and nature of entries received, and the Organizer may limit the number of winners depending on the number of Valid Entries received. The Organizer in this regard will entertain no communication. In case none of the Participants meets the criteria laid down in these T&Cs, or is otherwise in non-compliance with these T&Cs, the Organizer shall be entitled to not declare any winner.
The decision of the Organizer with regard to the validity of the post shall be final and no claim or the Organizer shall entertain communication with respect to that post by the Participant.
The winners will also be asked to share their details i.e. name, e-mail address, contact no etc. as requested by the Organizer on the direct message inbox.
The representatives of the Organizer through Facebook/Instagram/X (Twitter) direct message will contact the winners. The winners shall provide their details i.e. name and email, after the declaration of the result as requested by the Organizer. In case the winner does not respond with the required details as indicated in hereinabove and/or is not reachable or the Prize cannot be redeemed by him for any reason whatsoever, the Organizer will reserve the right to either forfeit the Prize or pass on the Prize to another Participant (chosen on the basis of originality and creativity of their Valid Entry) without any further notice to the winner who could not be contacted.
The organizer shall not be liable for any loss or non-receipt of the Prize due to an incorrect address or any other incorrect information provided by the Participant or the failure of any winner to take the delivery, for any reason whatsoever. The Organizer will be absolved of its liability after it has sent the Prize, to the address provided by the winner. The Organizer will not be liable for any failure to provide the Prize due to technical issues or any other logistical issues. The Organizer will not be liable for any loss of data during transmission including but not limited to server issues that may come up in the real-time monitoring of the entries sent out by Participants during the Contest Period, or in the declaration of winners.
The entry must not contain any provocative, objectionable, or inappropriate content
The Participants agree and undertake that their aforementioned posts will be their original creation and shall not in any way be obscene, vulgar, disrespectful or defamatory in any manner nor shall be in violation of any intellectual property rights of third parties and/or applicable laws. It is also clarified that the Participants are solely responsible for any violation of any applicable laws and shall keep the Organizer indemnified in this regard.
In case the Participant is found using external random software that entails fake re-posting tools, he/she will be disqualified from the Contest. The Organizer has all rights to verify the credibility of the post and to forfeit the Prize in case the Participant is found to be using such tools/software to increase the number of shares/likes or any other software which hacks or corrupts or otherwise tampers with the normal functioning of the Contest. The decision of Organizer shall be final and the Participants shall accept the decision as a binding one and shall in no event challenge the same. Subject to other terms and conditions contained herein, the participation shall be deemed to be made by the person who is the authorised holder of the Facebook/Instagram/X (Twitter) account used to send a reply as per Clause 6 above. In case a person uses the Facebook/Instagram/X (Twitter), login credentials of another person and uses such account to participate in the Contest, then the Organizer would be within its rights to deny any claim of both such persons, the one who used the login credentials of another person as well as such other person.
By submitting a valid entry in the Contest, the Participants agree that the Organiser may use the post for promotional and display purposes, and for any other use as may be deemed appropriate.
No act by the Organizer or its representatives under this Contest shall be construed as conferring upon Participants or the general public any right or interest in the intellectual property and/or in the other material/logos/trademarks/copyrights/artistic works in the posts/videos/images/GIFs shared by Organizer or its representatives. The intellectual property rights in such posts/videos/`images/GIFs shall vest with the Organizer perpetually and the Participants or winners shall not do any act to limit such rights of the Organizer.
The Participant agrees to indemnify and hold harmless Organizer and its officers, directors, employees, and affiliated organisations, and their respective officers, directors, shareholders, and employees, from and against any and all claims, demands, damages, costs, liabilities, and causes of action of whatsoever nature that are based upon or arise out of any breach by the Participant of these terms and conditions or the warranties and representations made by the Participant in this Contest.
Except as specifically set out herein and to the maximum extent permitted by law, all conditions, warranties and representations expressed or implied by law are hereby excluded. To the fullest extent permitted by law, Organizer hereby excludes and shall not have any liability to any Participant or winner in connection with or arising out of this Contest howsoever caused, including for any costs, expenses, forfeited Prize, damages and other liabilities.
Organizer assumes no liability or responsibility for (i) any errors, omissions or inaccuracies of content or submissions, (ii) personal injury or property damage of any nature resulting from participant’s access to, Participant’s exposure to or Participant’s participation in the Contest (iii) Any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information that may be contained therein (iv) Any deletion of data or interruption or discontinuance of transmission to or from or through the Contest.
The decision of the Organizer will be final and binding with regard to Contest and Prize and no correspondence will be entertained in this regard.
Organizer accepts no responsibility for any tax implications that may arise from the Prize-winning. Winners will have to bear incidental costs if any, that may arise for the redemption of the Prize. Prize money, if cash, is subject to applicable taxes at the time of settlement
The organizer shall not be responsible for any loss, injury or any other liability arising out of the Contest or due to participation by any person in the Contest.
All disputes relating to this Contest shall be subject to the exclusive jurisdiction of Courts at New Delhi only.
By participating in this Contest, it is assumed that the Participant has read the terms and conditions understood them in all aspects, has agreed to abide and be bound by them, and shall be held responsible in case of violation of the same.
